Terms of Service

These Terms of Service ("Terms") govern your access to and use of the services provided by Flight Crew Group, LLC ("Flight Crew," "we," "us," or "our"), including our managed AI service, the Flight Deck Shopify application, the Command Center, and our website at flight-crew.ai (together, the "Services"). By accessing or using the Services, you agree to be bound by these Terms.
Who these terms apply to
These Terms apply to any individual or entity ("you" or "your") that accesses or uses the Services, including ecommerce operators who engage Flight Crew for managed AI services, administrators of the Command Center, and visitors to flight-crew.ai. If you are using the Services on behalf of a business, you represent that you have authority to bind that business to these Terms.
What we provide
Flight Crew provides a managed AI service that generates recurring intelligence briefings, analysis, and recommendations for Shopify ecommerce operators. The Services include:
- Flight Deck — a Shopify application that connects your store's data to the Flight Crew service on a read-only basis.
- The Command Center — an operator interface for managing your engagement with Flight Crew.
- Briefings and analysis — AI-generated intelligence delivered on a recurring basis.
- Integrations — optional connections to third-party services such as Klaviyo, Google Sheets, Meta, and Instagram that you authorize.
The specific scope, cadence, and terms of your engagement are governed by the agreement between you and Flight Crew. These Terms apply in addition to, and are incorporated into, that agreement.
Account responsibilities
You are responsible for maintaining the confidentiality of any credentials used to access the Command Center and for all activity that occurs under your account. You agree to notify us promptly at hello@flight-crew.ai if you become aware of any unauthorized use of your account.
You agree to provide accurate, current, and complete information when setting up your account and to keep that information up to date.
Acceptable use
You agree to use the Services only for lawful purposes and in accordance with these Terms. You agree not to:
- Use the Services in any way that violates applicable laws or regulations.
- Attempt to gain unauthorized access to any part of the Services or related systems.
- Interfere with or disrupt the integrity or performance of the Services.
- Reverse engineer, decompile, or attempt to derive the source code of the Services.
- Use the Services to transmit any content that is unlawful, harmful, or otherwise objectionable.
- Resell, sublicense, or otherwise make the Services available to any third party without our prior written consent.
Data and integrations
Store and third-party data
When you install Flight Deck or authorize other integrations, you grant Flight Crew permission to access the data you make available through those integrations for the purpose of providing the Services. You represent that you have the right to authorize that access and that doing so does not violate any applicable agreement or law.
Third-party platforms
When you connect third-party platforms — including Meta, Instagram, Klaviyo, or Google — your use of those platforms remains subject to the respective platform's terms and policies. Flight Crew is not responsible for the availability, accuracy, or conduct of any third-party platform.
Meta and Instagram data
If you connect Meta Ads or Instagram accounts to the Services, you authorize Flight Crew to access performance data from those accounts (such as reach, impressions, and ad spend) solely to generate your briefings. We access only the permissions you grant and handle that data in accordance with our Privacy Policy and Meta's platform policies.
Your ownership
You retain ownership of your store data, customer data, and any other data you provide or make accessible through the Services. We do not claim any ownership interest in your data.
Intellectual property
The Services, including all software, models, templates, and content produced by Flight Crew (other than your data), are owned by Flight Crew Group, LLC and protected by applicable intellectual property laws. These Terms do not grant you any ownership interest in the Services.
Briefings and analysis delivered to you as part of your engagement are provided for your internal business use. You may not redistribute, resell, or publicly publish briefing content without our prior written consent.
Fees and payment
Fees for the Services are set out in your engagement agreement with Flight Crew. You agree to pay all fees when due. We reserve the right to suspend or terminate access to the Services if fees remain unpaid after reasonable notice.
All fees are exclusive of taxes. You are responsible for any applicable sales, use, or similar taxes.
Term and termination
These Terms remain in effect for as long as you use the Services or maintain an account with Flight Crew, unless terminated earlier as described below.
Either party may terminate the engagement in accordance with the terms of your engagement agreement. We may also suspend or terminate your access to the Services immediately if you breach these Terms or if continued access poses a risk to the Services or other users.
Upon termination, your right to access the Services ends. Sections that by their nature should survive termination — including intellectual property, limitation of liability, and dispute resolution — will survive.
Disclaimer of warranties
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, FLIGHT CREW DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.
Briefings, analysis, and recommendations generated by the Services are provided for informational purposes only and do not constitute professional financial, legal, or business advice. You are responsible for evaluating and acting on any information provided through the Services.
Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, FLIGHT CREW WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICES WILL NOT EXCEED THE FEES PAID BY YOU TO FLIGHT CREW IN THE THREE MONTHS PRECEDING THE CLAIM.
Governing law and disputes
These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles. Any dispute arising from these Terms or the Services that is not resolved informally will be resolved by binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive or other equitable relief in any court of competent jurisdiction.
You and Flight Crew agree that any dispute resolution will be conducted on an individual basis and not as part of a class or representative action.
Miscellaneous
Changes to these Terms
We may update these Terms from time to time. When we do, we will revise the "Last updated" date above and, where appropriate, provide additional notice. Your continued use of the Services after an update takes effect means you accept the revised Terms.
Entire agreement
These Terms, together with our Privacy Policy and any engagement agreement between you and Flight Crew, constitute the entire agreement between you and Flight Crew with respect to the Services and supersede any prior agreements on that subject.
Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
No waiver
Our failure to enforce any provision of these Terms will not be deemed a waiver of our right to enforce it in the future.
